Fox News sues Carnahan campaign

Fox News Network has sued the campaign of Missouri Democratic Sen. candidate Robin Carnahan for allegedly using unauthorized TV footage of newsman Christopher Wallace in a “smear ad” against opponent and GOP Rep. Roy Blunt, according to Bloomberg News.

The campaign used the video to suggest the network and Mr. Wallace were endorsing her against Mr. Blunt, Fox said Wednesday in a federal court complaint in Kansas City.

The network said Mrs. Carnahan, Missouri’s secretary of state, infringed its copyright by using in a 32-second campaign advertisement footage of Mr. Wallace interviewing Mr. Blunt. Fox, a unit of New York-based News Corp., said in the complaint that it has not endorsed a candidate in the race.

Representatives of the Carnahan campaign weren’t immediately available for comment, according to Bloomberg.

The case is Fox News Network LLC v. Robin Carnahan for Senate Inc., 10-00906, U.S. District Court, Western District of Missouri (Kansas City.)
