It looks like the appellate court did a little research on the subject. Environmental homeostatis for the most part impacts local conditions and populations. For the Federal government to manage such issues with blanket and in some cases extreme legislation from political and environmental lobbyist groups can critically handicap communities economic and physical welfare.
