This isn't about putting men on trial after the FBI or other law enforcement gathered evidence of wrong doing. This is about disposing of prisoners captured on the battle field. Just what evidence are soliders supposed to gather while in battle?
And Justice Kennedy did not "restore habeous corpus" rights to the prisoners of this war. He gave prisoners of war those rights for the first time.
We have seen how the terrorists dispose of prisoners (civilians at that beheaded in front of live cameras) and how Hezbollah disposed of Israel's two captured soldiers recently returned in coffins.

Many of the detainees at Guantanimo were not caught in the midst of battle but were either turned over to us off the battlefield or captured by us away from the battlefield. If it was as simple you seem to think RDH none of this would be an issue. What battlefield was Padilla captured on? He was arrested at Chicago O'Hare airport and then spirited away and held incummincado for years. US citizens, no matter how depraved, can be treated like that without endangering all of our freedoms.

Where is the Human Rights First report on that?" is wrong. No one expects psychopaths to behave in a civilized manner. No one need file reports on them. We all know how psychopaths behave. It is the behavior of Govt's that require scrutiny. Even a depraved psychopath needs to be subject to the rules of law or we become no better then they.
The sooner President 'torture' leaves office the better. Thanks God for the Constitution and the limits it places on the damage Presidents like Bush can inflict on the country.
