I'm not up on the details of this issue and do not know its merits. It all sounds kind of crazy. His mother was an American so his father's citizenship seems like a moot point. However, supposedly Obama's mother's age was too young to qualify him for American citizenship --- which sounds like a shaky line of reasoning. My bet is that the Supremes will decline to hear this. This could raise a real constitutional crisis, and, I'm sure, after the 2000 election controversy, they'll avoid that.

This is not a partisan issue. THIS IS ABOUT THE CONSTITUTION of the USA! The Constitution is what sets this country above all others. This is about 'natural born citizen' the ONLY place it is worded that way is to hold the office of President. Our fore fathers insight into how to protect this country is amazing. McCain is not eligible either. Both national parties are to blame for this fiasco... for not vetting their candidates, as well as the mass media for never diving into this. If this country wants to survive for another 200 years, we must adhere to this constitution. It can be amended, but it is to late for 2008 election.

The Natural Born Citizen requirement to be eligible for President was intended to avoid the possibility of divided allegiances. If Obama were a Naturalized Citizen that would disqualify him from holding the Office of President under this requirement. If he held dual citizenship, that too would disqualify him from holding office. Obama held British citizenship from birth to the age of 21 and he has already admitted holding dual citizenship with Kenya which is specifically unconstitutional per Article 2, Section 1, Clause 5. When Obama was born, Kenya was a British colony and still part of the United Kingdom. As a Kenyan native, Barack Obama Sr. was a British subject whose citizenship status was governed by The British Nationality Act of 1948. That same act governed the status of Obama Sr.‘s children. Thus, at the time of his birth, Obama was both a U.S. citizen (by virtue of being born in Hawaii) and a citizen of Britian by virtue of being born to a father who was a British citizen. - "British Nationality Act of 1948 (Part II, Section 5): Subject to the provisions of this section, a person born after the commencement of this Act shall be a citizen of the United Kingdom and Colonies by descent if his father is a citizen of the United Kingdom and Colonies at the time of the birth." The founding Fathers placed restrictions in the U.S. Constitution on who could be the President. It was deemed wise to restrict that post to individuals natural born and without dual citizenships. - Article 2, Section 1, Clause 5 of the U.S. Constitution: "No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution shall be eligible to the Office of President; neither shall any person be eligible to that office who shall not have attained to the age of thirty five years, and been fourteen Years a resident within the United States." If Barack Obama could produce a vault copy of his birth certificate that would verify his status as a "natural born citizen," he would do so. He could easily put the issue to rest by producing the document, rather than spending thousands of dollars on attorneys to defy federal and state lawsuits. Instead he has not and is doing everything possible not to comply. Obama has presented no defense to challenge the merits of the law suits. Instead Obama, his lawyers and the Democrat National Committe have resorted to legal wrangling to avoid accountability.

Jager, You're right, you're not up on the details. In 1961 there were different rules than now, and that is what rules here. His mother must not only be a citizen she must have lived in the US for 14 years at least 5 of which were after the age of 18. She doesn't fit. As for his birth in the US, that is the big question. If the supreams decide this without looking at a birth certificate or other absolute proof that he was born in the US then there will be more suites going to the SCOTUS. But BHO can stop all of this by allowing the records to be seen, one wave of a real birth certificate(open to scrutiny) and this goes away. Not some phony baloney "Certification" that nobody but staunch Obama supporters (and then only a very few of them) can examine in person.

Irs, A cogent analysis, but are you saying that the Supreme Court should interpret the Constitution's "natural born" requirement to mean that presidential candidates cannot ever have had dual citizenship? Unless dual citizenship or place of birth are issues, Obama seems to have a strong claim on this since he was born in Hawaii and his mother was an American. Does "natural born" mean that both parents must be American citizens?

As usual, the 'facts' are not facts at all. Where is the PROOF (An actual BIRTH CERTIFICATE appropriately authenticated by the local hospital/government on the actual date of birth.) that Obama was actually born in Hawaii? If the U S Supreme COURT brushes this off, none of their future decisions will mean anything.

I don't understand that Obama does not have the original copy of his Certificate of Birth. I, all members of my family and my friends all have theirs. In my family we even have the birth certificates of deceased family members even going back to greatgrandparents. What is Obama's problem? It sounds very suspicious to me.

It is absolutely disgraceful that the United States has 50 Secretaries of State who have not done their job. Mr. Obama is not the only illegitimate person on the ballot. That is what the states are supposed to protect from, the parties and the Congress and Courts in checks and balances. Right now, the Democratic Party headed by Howard Dean is guilty of sponsoring a fraud on the United States in not vetting a known problem. The Congressional Democrats knew all of this and is why they were passing a bill trying to sweep this away. Democrats should be furious over this betrayal of their trust by their leaders who have known this problem and just kept charging ahead just to get rid of Hillary Clinton. Well news is, as I have blogged that Hillary Clinton is Sec. of State. In the 25th Amendment Section 6, it states that the Sec. of State when both Presidential and Vice Presidential are disqualified will assume the presidency. This is going to be a huge legal problem Joe Biden was on an illegitimate ticket. Dick Cheney actually has a stake in this as much as Hillary and could be President. Including John McCain who will have the most electoral college votes, but what happens on the 15th of December if the people deceived vote for Mr. Obama? He is then President Elect, which means the election process if over and it then moves back into the Hillary and Dick venue. The entire liberal press and this DNC leadership is responsible for this and should be indicted for not doing their job. Obama's own website admits he was dual citizen which disqualifies him! I hope the Supreme Court decides this quickly as America does not need this going on and building for 4 years. Even Pravda in Russia is covering the story of the illegitimate Obama. America needs leadership and not 4 years of lawsuits which are indeed coming.

This is all rather simple and clear-cut unless you are a conspiracy-nut. The birth-cert HAS been produced to all the legally relevant agencies. Unfortunately,no matter how many times it is verified there will be a few cranks who will refuse to comprehend or accept that fact. Having accepted that Obama was indeed born in the State of Hawaii it is difficult to see what the claimants case might be. All that need be shown under the Constitution is: 1. Born in the USA 2. Never renounced US citizenship 3. Over 35 years of age 4. 14 years residency. The place of birth, nationality of either of his parents, or any foreign laws which might purport to determine their status, are absolutely irrelevant. However, the nutters who are in denial at the result of the election will keep wittering on to any one bothered to listen to them. I'm surprised that the WT is giving this story any prominence. Surely it has more relevant news to pursue - such as the latest sightings of Elvis.

A) Hawaiian law, at the time of Obama's birth, allowed for FOREIGN born (i.e. outside of Hawaii) baby's to be registered in Hawaii via a 'Certificate of Live Birth': "[§338-17.8] Certificates for children born out of State..." http://www.capitol.hawaii.gov/hrscurrent/Vol06_Ch0321-0344/HRS0338/HRS_0338-0017_0008.htm B) The Hawaiian govt' officials NEVER stated that Obama was born in Hawaii. They only stated that they have seen his birth certificate on file. But a B.C. from where?? (see #1 above). On October 31, 2008, Dr Chiyome Fukino, Department of Health, Hawaii, issued a press release in which she stated, in part: "...have personally seen and verified that the Hawai‘i State Department of Health has Sen. Obama’s original birth certificate on record in accordance with state policies and procedures." http://hawaii.gov/health/about/pr/2008/08-93.pdf For the Hawaiian 'Policies and Procedures' she refered to...see item #1 above which, again, affords foregin born babies to obtain a Hawaiian COLB (within 1 year). C) If proven Obama is indeed foreign born (Kenya), He would not have received U.S. citizenship based, only, on his mother's citizenship status. Per U.S. law at the time of his birth (December 24, 1952 to November 13, 1986). "If only one parent was a U.S. citizen at the time of your birth, that parent must have resided in the United States for at least ten years, at least five of which had to be after the age of 16." http://immigration.findlaw.com/immigration/immigration-citizenship-naturalization/immigration-citizenship-naturalization-did-you-know(1).html Obama's mother would have had to have given birth to him when she was 21 (16 + 5). She didn't. Therefore, Obama could not obtain U.S. citizenship based only by virtue his mother's citizenship. Why hasn't he posted his Long form COLB? E) And last but not least, Factcheck themselves state that Obama was indeed a British subject and did in fact hold dual citizenship AT Birth. http://www.factcheck.org/askfactcheck/does_barack_obama_have_kenyan_citizenship.html "In other words, at the time of his birth, Barack Obama Jr. was both a U.S. citizen ... and a citizen of the United Kingdom and Colonies (or the UKC)" Obama could therefore not be a Natural Born citizen because Natural Born citizens can not hold dual citizenship at birth. It has to do with the potential for divided loyalties.

Nuts indeed! How is it that we have spent the last eight years, including the election cycle, listening to all sorts of outrageous conspiracy theories aimed at destroying Republicans, and now one question is asked about Barry (if that is indeed his real name) and the questioners are all "conspiracy-nuts." Welcome to the other side of the conspiracies libs. It is like Alex Jones, the conspiracy theorist of all conspiracy theorists said, "When the Republicans were in office the Democrats loved the conspiracy theories about Bush, now they all hate me for pointing out Obama's faults, inconsistencies, and horrendous policies." You can't have it both ways. All the other politicians released everything from college transcripts to frequency of bowel movements. Barry is not above scrutiny or questioning. Provide the full documentation and it all goes away. We might be able to even "come together."
