It is also more difficult when the Republic is out of balance. What can evolve is a power elitism that can lock up the system. We have seen that for the past eight years. We have seen it in the oscillations of the recent Suprement Court decisions. The system has become dysfunctional. In a representative form of government we abrogate some our responsibilities to select groups. For the past 100 years or so, it has been two groups. Perhaps it is time to take back some of those responsibilities and form a third group. When it comes to the "evolving standards of decency that mark the progress of a maturing society" decisions with regard to the Constitution, they should not be left to nine social intellectuals. Those decisions should be left to the maturing society through referendum.
