The Constitution allows for such instances with the VP making the call. That is not "cruel" it is the Constitution. What would be cruel would be the hanging chad legal lobbying that would follow.

The article is spot on as far as this possibility of a tie and the Democrats will scream, rant, whine, name call, riot, etc. if Cheney gets to choose. Stock up on your gardens, guns, and gold folks. "But despite the delicious possibility that Mr. Cheney would break a Senate tie to create a Obama-Palin White House, several other constitutional scholars say, forget the Constitution. They say the operative - and decisive - verbiage was set out in U.S. Code Title 3, Chapter 1, Section 15, in 1934." WRONG! You can't "forget the Constitution", regardless of what liberals say. The 1934 law runs afoul of the Constitution's specific language of which Congress picks the president and VP. Therefore, by definition, the 1934 law is unconstitutional. Sorry, liberals, but the Constitution trumps all.

But the vote in the House of Representatives gives only ONE VOTE per STATE DELEGATION! While the Democrats have a majority, do they control a majority of state delegations? Can someone confirm this?

You made one mistake. The Senate has no role in choosing the President in the case of a tie. It is solely a choice of the House of Representatives. The Senate does, however, choose the Vice President in the case of a tie. So if a Vice President is chosen, but a President is not, the Vice President-elect becomes acting President until the House of Representatives makes a choice.

Everyone is forgetting about Senator Chuck Hagel from Nebraska. He's a republican, but he's a Barack Supporter. So, Lieberman swings over to vote for McCain, but Hagel swings over to vote for Barack. In this scenario HAGEL IS THE KINGMAKER, not Cheney or Lieberman.

WHO ARE THE CONSTITUTIONAL SCHOLARS THAT BELIEVE THE CURRENT CONGRESS WOULD MAKE THE SELECTION? THE MANDATED TIMELINE WOULD MAKE THAT IMPLAUSIBLE. THE COUNTING OF THE ELECTORAL VOTES IS THE FIRST DUTY OF THE NEW CONGRESS, HOUSE AND SENATE SITTING TOGETHER. ONLY THEN IS THE ELECTORAL COLLEGE VOTE FOR PRESIDENT AND VICE PRESIDENT DECLARED OFFICIAL. IF THERE IS NO MAJORITY, OR A TIE, THE HOUSE IS MANDATED TO IMMEDIATELY CHOOSE A PRESIDENT, ONE VOTE PER STATE; THE SENATE CHOOSES A VICE PRESIDENT, ONE VOTE PER SENATOR.

Why Can't we just have Obama and McCain settle it in a duel like Burr and Hamilton??? Oh, right, that would put the Anti-gun, Liberal, Fascist, Non-Citizen, guy from Gun-Free, crime-ridden Chicago at adisadvantage. Shucks!!!

Another Nebraska angle to this story is that only Nebraska and Maine split their respective electoral college votes along congressional district lines. It is quite possible that the 2nd. congressional district of Nebraska (Omaha and suburbs) could go democratic which could make a difference in a tight race!

Any real republican would reject the GOP. They have been in control and what do we have to show for it? A war that will cost us trillions all based on lies. A dollar worth less than the ink used to print it. Gas hovering at 2-1/2times what it was worth when they took charge. Spying on American citizens. Torture. Tax dollars propping up the rich. Worst and certainly not least, they have proven themselves impotent in the hunt for Osama bin Laden. Republicans have a habit of voting for the dumb guy lets all hope that it doesn't happen this time.
