Well stated. The cynical me thinks that Harry Reid hopes that the Supreme Court quickly orders him to seat Senator Burris. That way he can have fought against Blago’s appointee, attempting to preserve some moral high ground. At the same time, he will have Burris as a loyal Democratic vote in the Senate, getting what he ultimately wants as well. Kind of a have your cake and eat it too scenario.
Good points. I despise Blago, but it's difficult to argue against Mr. Fein's assertions. Unfortunately, this manipulation of the system by Gov. Blagojevic may be unethical, but entirely constitutional.
Can't add any comment to this other than to say the problem would not have been here if the Illinois legislators would have done their job and the prosecutor certainly didn't keep Blago from appointing a new Senator. Was the seat sold? How would that comport with the constitution? It would have met the basic requirements of the Constitution.
The Constitution has never stood in the way of the Democratic lead Congress, why should this be any different? If we had a mainstream media that had any integrity, they would be able to frame the issue. They are just waiting for the great Obama to speak. Problem is, he leads by committee and that committee is the DNC and the Democrat lead Congress.
This article is largely tripe. Sure, the courts can require the seating of Burris, but the same article of the constitution allows the houses of congress to police their own membership. In short, seat him, then expel him. Frankly, I'll be surprised if the court even touches this.
