Former choir director sues Tupelo school system

ABERDEEN, Miss. (AP) - A judge has dismissed a lawsuit filed by a former Tupelo schools music teacher against the district.

The Northeast Mississippi Daily Journal reports (http://bit.ly/OdqaNx ) Calvin Ellis sued the school district for breach of contract, interference with his contract, violation of his constitutional right to due process and violation of his right to equal protection.

U.S. District Judge Sharion Aycock in Aberdeen ruled this week Ellis' arguments were denied after a 10-day hearing before the Tupelo school board and hearing officer.

The school board upheld his firing with a 3-1 vote, which Ellis did not appeal. S

Aycock said since Ellis didn't appeal to chancery court, the result of the termination hearing was conclusive and cannot be retried in federal court.

Ellis filed the lawsuit in federal court in 2012.
