In a court filing made public Wednesday, an attorney for Louisiana Gov. Bobby Jindal called the Obama administration’s Common Core testing platform a carefully orchestrated “scheme” to control the states’ education systems.

Mr. Jindal is already involved in a legal battle to combat the testing in his home state, and has filed for an injunction to ban Common Core testing.

Louisiana is among several states participating in the Partnership for Assessment of Readiness for College and Careers (PARCC), which works to create standardized tests built around Common Core.

In the injunction request, attorney Jimmy Faircloth called PARCC “the implementation platform for a carefully orchestrated federal scheme to supervise, direct and control educational curriculum, programs of instruction and instructional materials in direct violations of federal law.”


Mr. Faircloth added the “scheme is being perpetrated on the pretext of higher standards promised by Common Core.”

Both PARCC and the testing group Smarter Balanced were funded by grants from the Obama administration’s Race to Top program.

Louisiana joined the Common Core under Mr. Jindal, but the Republican governor has turned against the program as he mulls whether to pursue the GOP 2016 presidential nomination.

In an amended court petition, Mr. Jindal wrote that the Obama administration’s Race to the Top has “effectively co-opted Common Core for the federal government, attempting to accomplish indirectly through economic coercion that which the federal government is prohibited from accomplishing directly.”

Mr. Jindal argued that states were given incentives to adopt the standards and assessments despite constitutional restrictions and is concerned the program will force educators to teach students based on the curriculum tested in Common Core.

“Common Core began as an effort to simply raise standards for students, but it has morphed into a scheme to drive education curriculum from Washington, D.C.,” Mr. Jindal said.

“Congress drew a bright red line that can’t be crossed and it clearly bars the federal government from ‘directing, supervising or controlling elementary and secondary school curriculum, programs of instruction and instructional material.’ Implementing PARCC in Louisiana crosses the line because what’s tested is what’s taught. PARCC is a federal agent for co-opting our school’s curriculum.”
