LOUISVILLE, Ky. (AP) - A Jefferson County judge has dismissed a lawsuit against former Louisville assistant basketball coach Steve Masiello that claimed Masiello kept $50,000 instead of producing Kentucky Derby tickets for a broker.

WDRB-TV (http://bit.ly/1pQdERQ ) reported that Circuit Judge Charles Cunningham said in dismissing the lawsuit Tuesday that Masiello has had a “cloud over his good name.”

The plaintiff, Scott Davis, who operates DerbyDeales.com, didn’t appear for deposition Monday, and his lawyer, Garry Adams, said he had been unable to contact Davis. Adams withdrew from the case.

Masiello repeatedly denied the allegations. His attorney, Tim McCall, said he spoke Tuesday with Masiello, who is now coaching at Manhattan College. McCall said Masiello is fine and that the lawsuit was not a “big concern of his.”
