MORGANTOWN, W.Va. (AP) - A bankruptcy judge has approved a settlement allowing a Longview Power subsidiary to continue to discharge treated mine water into Dunkard Creek.

The settlement arose from negotiations between Longview and Pennsylvania regulators to determine an alternative means of compliance with the state’s new requirements.

Longview subsidiary Dana Mining and another company, AMD Reclamation, operate a facility in Pennsylvania that pumps and treats water from abandoned mines. Longview had said it would have to invest in additional treatment facilities to meet requirements implemented by the Pennsylvania agency since the facility received a discharge permit in 2003.

The settlement includes expanding the treatment facility’s capacity and reach. Longview says this will reduce or eliminate discharges into Dunkard Creek.
