ANAHEIM, Calif. (AP) - Prosecutors in Orange County say they will not file charges against a homeowner who shot and wounded an intruder on Christmas morning.

The Orange County Register reports (http://bit.ly/1F2dleh) the district attorney’s office said Monday that 36-year-old Nathanael Blair acted in self-defense. A spokeswoman says there is no evidence to support charges.

Blair was surprised in his garage by a ski-mask-wearing burglar who threw a pipe wrench at him, hitting him in the jaw and neck.

Blair ran upstairs and grabbed his 12-gauge shotgun, chased the burglar and fired his shotgun.

Blair says he knew he hit the intruder because the man screamed in pain. The suspect got away but was later caught.

Twenty-nine-year-old Jeremy Bell has pleaded not guilty to felony burglary and assault charges.
