PROVIDENCE, R.I. (AP) - Prosecutors say criminal charges have been dropped against a man and a woman who were accused of having sex outside a Family Dollar store in Rhode Island.

Prosecutor Thomas DeSimone tells The Providence Journal (http://bit.ly/1I4tNR5 ) he was forced to drop the charges against the couple Monday because police had no in-person witnesses to the alleged sex act in Woonsocket, which police said was captured on a Facebook video.

DeSimone says he also took into account that 33-year-old Danny Folco, of Woonsocket, and 35-year-old Jennifer Bonsante, of Smithfield, have received counseling since the incident.

Police had said in May that they were called to the store on a report that the two were having sex in plain view. The pair was charged with indecent exposure and disorderly conduct.
