MORRISTOWN, N.J. (AP) - A judge says it “defies belief” that a former police sergeant who stole $29 in breakfast sandwiches didn’t realize he would be barred from having the conviction expunged.

Under the deal, former Rockaway Township police Sgt. Christopher Stahl pleaded guilty in 2008 to a disorderly persons offense of theft. He’s no longer allowed to hold public employment.

Stahl has since filed a motion seeking to vacate the guilty plea, claiming his attorney didn’t adequately explain his options.

A state Superior Court judge said Monday that it “defies belief” that an experienced law enforcement officer represented by an experienced attorney did not understand the agreement. The judge called the case an instance of “buyer’s remorse.”

An official ruling has not been issued.
