HERSHEY, Pa. (AP) - The district attorney says an eastern Pennsylvania woman was justified in fatally shooting her husband while he was choking her.

Lebanon County District Attorney David Arnold says Kelly Urban won’t be criminally charged in the July 3 shooting at the couple’s home in South Londonderry Township.

That’s where police were called about 1 a.m. by Urban, who reported shooting David Urban.

Police say Kelly Urban was crying and upset and had her hands in the air when police arrived.

She told police her husband led her into their bathroom and handed her a handgun, saying the only way to stop him was to shoot him.

Urban told police she was losing consciousness when she shot her husband in the abdomen.

The DA says Urban’s story never wavered and was supported by other evidence.
