DENVER (AP) - U.S. prosecutors say former Qwest Communications International Inc. CEO Joseph Nacchio should report to prison as scheduled by noon March 23 while he challenges his insider trading conviction.

Nacchio last week asked a judge to reconsider her ruling denying his request to remain free on bail while the Supreme Court reviews his case.

The government contends in a federal court filing Monday in Denver that to warrant bail, Nacchio still needs to show a ruling in his favor would likely result in a reversal or new trial.

U.S. District Judge Marcia Krieger had ruled last week that Nacchio’s request to remain free was premature because Nacchio hadn’t asked the Supreme Court for a review yet, though his attorney plans to do so.
