BEAUFORT, S.C. (AP) - A Beaufort County jury has ruled for the county sheriff’s office in a civil lawsuit alleging officers maliciously prosecuted a Hardeeville man for assault back in 2008.

The Island Packet reports (https://bit.ly/1uqmatbh ) jurors returned the verdict Wednesday.

Theophilus Hamilton sued the county saying there was no probable cause to arrest him. Hamilton was acquitted in August 2010, along with a co-defendant.

That man, Henry Chris Battle Jr., sued and settled with the county for $30,000. Hamilton rejected the settlement.

In rendering the verdict, the jurors decided there was probable cause to arrest Hamilton.

Hamilton’s attorney argued investigators did not corroborate information from the only person convicted in the attack and failed to check out his client’s alibi that he was home with his mother at the time.
