WELCH, W.Va. (AP) - A judge has dismissed an indictment charging a McDowell County magistrate with falsification of a court document.

Mercer County Circuit Court Judge Omar Aboulhosn’s order says the state can’t prove that Magistrate Steve L. Cox committed a crime.

Cox was accused of adding a hand-written note to a court note.

Aboulhosn’s order also says Cox did his duty as a magistrate when he denied petitions by Kevin B. Wade. Wade’s petitions had sought personal safety orders against various law enforcement officers of the county.

The Bluefield Daily Telegraph (https://bit.ly/1vgjMcL ) reports that Aboulhosn issued the order Thursday. He was a member of a three-judge panel appointed by the West Virginia Supreme Court to hear the case.
