MORGANTOWN, W.Va. (AP) - A former West Virginia University auditor’s lawsuit over his firing has been dismissed.

U.S. District Judge Irene Keeley’s order says R. Michael Kennedy-Chuey didn’t serve the lawsuit on the defendants. He also didn’t respond to a federal magistrate’s show cause order.

Kennedy-Chuey sued the WVU Board of Governors and WVU senior associate vice president for finance Dan Durbin in December 2013. The lawsuit alleged that Kennedy-Chuey was fired for complaining about misuse of federal stimulus funds.

Kennedy-Chuey’s lawsuit said he was hired in 2006 as an internal auditor and was fired in 2013.
