JACKSON, Miss. (AP) - A Mississippi man is asking the U.S. Supreme Court to throw out his aggravated DUI conviction related to a 2012 accident that left a woman in a coma for weeks.

Frank Gideon Whitaker IV, now 29, was convicted in Warren County in 2013 and was sentenced to 15 years in prison.

Authorities say Whitaker’s truck collided head-on with a vehicle driven by 54-year-old Cynthia M. Grantham.

Grantham was taken to University Medical Center where she remained in a coma for several weeks, according to court records. She suffered head injuries and a shattered leg.

The Mississippi courts rejected Whitaker’s arguments that a blood test used to establish that he was driving drunk at the time of the accident was unreliable and was not provided the defense for independent testing.
