ALBANY, N.Y. (AP) - Two lawsuits have been filed in federal court in Albany against a 65-year-old Canadian truck driver whose rig slammed into a state police cruiser and killed a 35-year-old trooper on the New York State Thruway.

Both the estate of deceased trooper David Cunniff and Eric Heller, the driver Cunniff pulled over before the fatal crash last December, are suing Gary Blakley of Ridgeway, Ontario and the company he worked for.

Both lawsuits allege Blakley was negligent. He was not charged at the time and was allowed to return to Canada.

Montgomery County District Attorney Jed Conboy tells the Schenectady Gazette (https://bit.ly/1qR3i9l ) a grand jury has met to consider evidence in the case and has concluded its work. He declined to elaborate.
