TUCSON, Ariz. (AP) - A new court ruling says a person can be convicted of burglary for stealing items from the open bed of a pickup truck.

An appeal filed on behalf of a woman convicted in Pima County Superior Court in the theft of tools from the bed of a pickup truck had argued that the burglary law didn’t apply because it applies thefts from structures.

But the state Court of Appeals ruled that Arizona criminal law clearly considers vehicles to fall under the definition of a structure and that it doesn’t matter under the same law whether or not a truck’s bed is open or enclosed.

The ruling by a three-judge panel based in Tucson upholds the convictions and sentences of Joann Bon.
