DOVER, Del. (AP) - A Kent County judge has ordered a hand recount of absentee ballots in the local recorder of deeds race.

Tuesday’s ruling involves the disputed results of the Nov. 4 election, which ended with Republican La Mar Gunn being declared the winner by only two votes out of almost 38,500.

The county board of canvass did three recounts of absentee ballots, with two recounts adding one and four votes, respectively, to Gunn’s margin. But the third recount gave incumbent Democrat Betty Lou McKenna a two-vote lead. The board chose to certify that recount, making McKenna the winner.

Republicans then filed suit challenging the board’s decision, which Gunn said amounted to “malconduct.” The judge agreed, noting that malconduct does not mean the board acted maliciously or intentionally to thwart the democratic process.
