ALTOONA, Pa. (AP) - A man has been convicted of third-degree murder, not the first-degree conviction prosecutors sought in a fatal Pennsylvania nightclub shooting on Halloween last year.

Twenty-one-year-old Hugo Baez had argued the killing was in self-defense, but a Blair County jury convicted him late Friday. He now faces up to 40 years in prison when he’s sentenced Jan. 29.

Baez fatally shot 24-year-old Willie Solomon at Choices Nightclub in Altoona. Authorities allege that Baez had argued with Solomon’s brother and fired a shot at the brother as both men headed outside to fight. Investigators say Solomon then grabbed Baez and tried to take the gun from him, before Solomon was shot three times.

A separate jury must still try 24-year-old Brandon Midder, another Altoona man, who’s charged with assault and other crimes for allegedly attacking Solomon after he was shot.
