BOZEMAN, Mont. (AP) - Attorneys for escaped attempted rape suspect Kevin Briggs are asking a judge to dismiss charges because they say police got rid of the victim’s cellphone after making copies of selected calls and texts.

Attorneys also say officers lacked suspicion to arrest Briggs and they are asking that a felony drug charge be dropped because of a lack of probable cause.

Briggs was arrested after a woman he knew reported that he tried to rape her. He escaped from a police interview room after police left him unattended.

The Bozeman Daily Chronicle reports ( ) Briggs was arrested in Portland, Oregon, and returned to Gallatin County.

Briggs pleaded not guilty to all charges and is scheduled to go to trial in Gallatin County District Court in February.
