NEWPORT, R.I. (AP) - A judge has dismissed a lawsuit seeking to prevent a welcome center on the grounds of The Breakers mansion in Newport, although a second lawsuit is still pending.

The Newport Daily News reports that Superior Court Judge Bennett Gallo on Friday dismissed the lawsuit brought by the Bellevue Ochre Point Neighborhood Association against the Preservation Society of Newport County. It argued that the zoning rules prohibit such a center.

The other lawsuit appeals the zoning board’s decision to overturn the Historic District Commission, which had rejected the planned $4.2 million welcome center. It found the project was incompatible with local historic standards.

That case is scheduled a hearing for Aug. 6.
