DOVER, Del. (AP) - A federal judge has refused to vacate the sentence for kidnapping and fraud of a former Delaware optometrist now awaiting trial on federal stalking charges in the death of his ex-wife.

The judge this week rejected David Matusiewicz’s claims of inadequate attorney representation in the 2009 case. Matusiewicz pleaded guilty to parental kidnapping and bank fraud after forging his ex-wife’s signature on mortgage documents and taking their three daughters to Central America.

Matusiewicz, his mother, and sister are now charged with conspiracy and stalking of his ex-wife, Christine Belford.

Belford and a friend were fatally shot by Matusiewicz’s father in 2013 at the New Castle County courthouse. Thomas Matusiewicz then exchanged gunfire with security officers before killing himself. His relatives have denied any knowledge of his plans to kill Belford.
