BEAUFORT, S.C. (AP) - A judge has refused to order a new trial for a tow truck driver convicted in the Beaufort County shooting death of another man.

The Island Packet of Hilton Head reported (https://bit.ly/1pWyBPl) that Circuit Judge Brooks Goldsmith has agreed to reduce Preston Oates’ sentence from 26 years in prison to 24 years.

Oates was convicted of voluntary manslaughter and possession of a weapon during a violent crime in the Christmas Eve 2010 shooting death of Carlos Olivera in Bluffton that resulted from a dispute about a booted minivan.

Prosecutor Sean Thornton says Goldsmith agreed with Oates’ lawyer that he should get credit for the time he was under house arrest awaiting trial.

Oates is appealing the manslaughter conviction to the South Carolina Court of Appeals.
