SIOUX FALLS, S.D. (AP) - Proposed legislation in South Dakota would allow residents to have wine delivered directly to their homes, but it comes with restrictions that advocates say might be unpalatable.

South Dakota is one of only a few states that don’t allow alcohol shipments to private residences. Wineries and consumers have pushed to change the law in recent years but with little success because of opposition from retailers and wholesalers.

Representatives of the state’s alcohol retailers and a major wholesaler have now crafted a compromise bill that would allow direct wine shipments but with several restrictions, the Argus Leader reported (https://argusne.ws/1oE00Sk ).

Wineries and delivery companies would have to get state permits and make monthly reports to the state Department of Revenue with the names and addresses of everyone who received shipments to ensure the state sales tax was paid. Wineries also would have to choose which wine varieties to sell in stores and which to sell directly to consumers.

Jeremiah Murphy, lobbyist for Republic National Distributing Co., said the proposal is targeted at vintages that can’t be found in South Dakota.

“There are a lot of wines that are not in distribution in South Dakota,” he said. “It is those wines that are covered by this bill.”

Murphy said the limitations are intended to create the smallest disruption to the current system, in which all alcohol deliveries have to go through wholesalers such as Republic National. Advocates of direct wine shipments say the proposal might be too restrictive.

“My concern is you’re building in additional roadblocks to not allow the wine to be shipped directly to an individual,” said Diana Miller, lobbyist for a group that supports wine shipments.

Lawmakers will decide this summer whether the 2015 Legislature will consider the proposed bill. Murphy and Miller will negotiate their differences before the legislators meet again in September.
