GREENVILLE, Miss. (AP) - A Greenville city judge has dismissed capital murder charges in a fatal stabbing case, saying police failed to prove the attack was not in self-defense.

Kevin Boston was charged with capital murder on May 15, the day after a custodian - 43-year-old Willie Dean III - was fatally stabbed in the parking lot of Susie Trigg Elementary School.

The Delta Democrat-Times reports (https://bit.ly/1nwZnJN ) Municipal Judge Michael Prewitt threw out the case this past week. Boston has been released from jail.

Assistant Police Chief Delando Wilson says police will give their investigation report to the district attorney’s office for possible presentation to a grand jury.
