BURGAW, N.C. (AP) - A prosecutor has ruled a North Carolina state trooper will not be charged in the shooting and killing a man who pointed a shotgun at him as he investigated a pickup truck that ran into a home in Pender County.

District Attorney Ben David said 67-year-old Maynard Thomas caused his own death by his actions.

Investigators say a Pender County deputy wanted to talk to Maynard at his Hampstead home in April about damage to his pickup truck. A woman who lived nearby reported a truck struck her home and drove away.

Authorities say Thomas refused to talk to the deputy and shot at him.

Investigators say trooper Josh Kiser joined the deputy to approach Maynard’s house again, and fired the fatal shot after Maynard wouldn’t drop his gun.
