SOUTH BEND, Ind. (AP) - The South Bend Common Council president has dismissed misconduct charges against a council member who posted obscene material on his Facebook page.

The South Bend Tribune reports (https://bit.ly/1nBDJRE ) council President Oliver Davis approved a motion Monday saying the charge against Henry Davis Jr. should not have moved past the Rules Committee.

Some city residents complained when Davis posted an explicit photo in January of a naked man and a dog with a link to a blog that said Congress had legalized sex between humans and animals for members of the military.

A special prosecutor announced last month he wouldn’t file criminal charges against Davis because he didn’t understand he was breaking the law.

Davis says he’s ready to move forward. He previously called the posting a mistake.
