CARMEL, N.Y. (AP) - An appeals court has upheld the 2012 conviction of a man in the 1994 rape and murder of a 12-year-old New York girl.

Anthony DiPippo was first convicted and sentenced in 1997 in the death of Josette Wright of Carmel. An appeals court ordered a retrial after finding that DiPippo’s lawyer had not disclosed a conflict of interest.

DiPippo appealed on grounds including that he was unable to present evidence that another person could have committed the crime.

The Journal News (https://lohud.us/1laJBUz ) reports that on May 28 the New York Supreme Court Appellate Division upheld the conviction and found the sentence appropriate.

DiPippo is being held at a prison in Sullivan County.
