BUFFALO, N.Y. (AP) - The Buffalo Common Council has chosen a new operator for the city’s Lake Erie marina after an audit revealed the previous contractor failed to pay more than $500,000 in rent.

Local media report that the council on Tuesday awarded a five-year contract to Smith Boys of North Tonawanda to operate the Erin Basin Marina. The agreement includes provisions for gas sales and the maintenance of gardens and a beach.

The former contractor, Brand-On Services, had its contract terminated after a city audit last summer found the company failed to pay about $515,000 in rent.

The company has disputed that figure, contending much of the work it performed was done at the direction of the city and should be deducted from its rent.

The marina opens May 1.
