WASHBURN, N.D. (AP) - Police have charged a Fargo woman with negligent homicide after the passenger she was driving an ATV with was ejected and killed.

KXMB-TV reports (https://bit.ly/1G6rV6i ) that Carla Keller had a blood alcohol content of .098 when Patrick Anderson was thrown off the ATV in McClean County. The incident happened on August 31. It’s unclear why a criminal complaint was filed Friday.

The North Dakota Highway Patrol alleges that Keller was driving the ATV in a ditch when it vaulted off an approach.

Anderson was bucked from the vehicle. He later died of his injuries.

Negligent homicide is a Class C felony that carries a maximum sentence of five years in prison.

An attorney was not listed for Keller on Saturday.

She’s scheduled to appear in court on Dec. 3.
