DEVILS LAKE, N.D. (AP) - A judge has ruled that North Dakota game wardens improperly searched a Devils Lake rental home where five Wisconsin anglers were caught last summer with what authorities said was an illegal amount of fish.

Judge Lee Christofferson says game wardens failed to get a warrant or obtain proper consent. His ruling means evidence in the case can’t be used to prosecute the men.

Ramsey County State’s Attorney Lonnie Olson tells KZZY radio that he won’t appeal the ruling, and the case against the men likely will be dismissed.

Authorities allege that the men had 100 more walleye than allowed by state law. Each angler faced fines of more than $1,700.
