JACKSON, Miss. (AP) - The Mississippi Supreme Court has upheld an earlier order granting a new trial for a Harrison County man convicted of murder in a 2009 fatal shooting.

The Supreme Court on Thursday dismissed a request from prosecutors to take another look at the case of Harvill Payne Richardson Sr.

In June, the Supreme Court found a Harrison County judge erred in not letting Richardson argue the death of Rudy Quilon was self-defense. The court said there was evidence that might persuade a jury that Richardson acted because he felt threatened by Rudy Quilon.

Richardson was sentenced to life in prison in 2011. Prosecutors say the two men were arguing in the backyard of Richardson’s Biloxi home when the shooting occurred.

Prosecutors argued Richardson was the aggressor and provoked the incident.
