VISTA, Calif. (AP) - A retired Newport Beach policewoman sentenced to nine years in prison for a drunken-driving crash that killed one person is out on bail after her conviction was overturned last month.

U-T San Diego reports (https://bit.ly/ZsNk8c) 53-year-old Katherine Ann Heinzel posted $100,000 bail Oct. 2. A new trial is set for March.

A three-judge panel reversed the conviction after determining the trial judge made an error when he instructed the jury as to the law.

Heinzel was arrested November 2011 in Fallbrook after she rear-ended a car. Both cars went through a guardrail and down a hill.

The other driver, 20-year-old Davieonne Kelly, died at the scene.

Heinzel investigated traffic collisions, including drunken driving collisions, when she was a Newport Beach police officer from 1986 to 1994.

She was a private investigator at the time of the crash.
