PRINCETON, W.Va. (AP) - A West Virginia State trooper will not be charged in the fatal shooting of a Mercer County man.

The Bluefield Daily Telegraph (https://bit.ly/1qDW9mW ) reports that a grand jury weighed the evidence in the shooting of 18-year-old Timothy Hill in June and did not return charges Thursday against Senior Trooper B.D. Gillespie. He is assigned to the Welch Detachment.

The shooting occurred after Gillespie’s wife saw three men in their driveway tampering with their vehicles. Gillespie located the men three miles from his home in Mercer County.

State police say Hill became belligerent when Gillespie questioned him and the other men. Investigators say Gillespie fatally shot Hill during a struggle.
