DAVENPORT, Iowa (AP) - A lawsuit filed by the family of a man fatally shot by a Van Buren County sheriff’s deputy two years ago has been transferred to federal court in Davenport.

The Hawk Eye reports (https://bit.ly/1vsNPfi ) that an attorney representing Van Buren County Deputy Sheriff Jon Tharp sought the transfer.

Tharp responded to reports about an armed man walking on a highway’s shoulder in 2012.

The Iowa Division of Criminal Investigation says Tharp acted in self-defense when he opened fire at R. Michael Dooley.

But the lawsuit against him says Tharp shot Dooley before Dooley could obey orders to put down his weapon.



Tharp still works as a deputy in Van Buren County.
