BARTLETT, Tenn. (AP) - Two people have been charged with leaving fetus near a trash bin behind a fried chicken restaurant in Bartlett a year ago.

Police say they didn’t charge 22-year-old Kalandra Lacy and 23-year-old Michael Baines with murder because the medical examiner’s office couldn’t determine if the baby was alive at the time of delivery.

Lacy is charged with abuse of a corpse. Baines faces a charge of accessory after the fact and tampering with evidence. Both were indicted earlier this month.

The Commercial Appeal reported (https://bit.ly/1rpwWMs ) that Lacy delivered the fetus in the restaurant bathroom after 36 weeks of gestation.

A passer-by found the infant’s body on Oct. 19, 2013, near a large waste receptacle behind a strip center.

Jail records did not list an attorney for either Lacy or Baines.
