WEATHERFORD, Texas (AP) - A North Texas judge has determined a teenager accused of fatally shooting his mother and 15-year-old sister is incompetent to stand trial.

Nineteen-year-old Jake Evans will be sent to a state mental hospital for up to 120 days.

Parker County prosecutor Robert DuBoise said in a statement Tuesday that Evans could eventually be tried on capital murder charges if mental health professionals “can assist him in regaining competency.”

Investigators say Evans killed 48-year-old Jami Evans and his sister Mallory in October 2012 at their home before calling 911 and confessing. The Fort Worth Star-Telegram reports (https://bit.ly/1wi8sdq ) a recording of the call shows Evans saying his mother and sister “were just suffocating me.”

A grand jury previously indicted Jake Evans on one count of capital murder and two counts of murder.
