YULEE, Fla. (AP) - A Florida sheriff’s deputy is in jail on a kidnapping charge after an Amber Alert was issued for her son.

The Florida Times-Union (https://bit.ly/1DzLrGi ) reports St. Johns County deputy Catherine Payne was arrested Tuesday night in north Florida.

St. Johns Sheriff’s spokesman Chug Mulligan says 37-year-old Payne and the child were located in nearby Nassau County shortly after the alert was issued and the situation turned out to be a misunderstanding between the boy’s parents.

Mulligan says Payne didn’t have legal custody and notified authorities after seeing the Amber Alert.

Payne and her husband filed for divorce in September.

The child was returned to his father, Florida Highway Patrol trooper Phillip G. Payne.

Catherine Payne is being held on $5,000 bail. It wasn’t clear whether she’s hired an attorney.
