MUNHALL, Pa. (AP) - A western Pennsylvania man has avoided prison for a garage burglary in which his co-defendant was killed in a gunfight with a homeowner.

Twenty-five-year-old Shaun Conroy, of Munhall, was sentenced Monday after previously pleading no contest to burglary and conspiracy charges in the September 2011 incident.

That’s when 57-year-old John Rozgonyi confronted Conroy and 23-year-old Andrew Stevens as they broke into a garage where Rozgonyi kept his classic 1977 Ford Mustang.

Allegheny County District Attorney Stephen Zappala Jr. determined Rozgonyi was justified in fatally shooting Stevens who traded shots with Rozgonyi about 3:30 a.m.

Conroy ran out of the garage, but returned when he heard the gunfire and was arrested at the scene.

Police say he and Stevens decided to break into the garage after a night of drinking.
