CLEVELAND (AP) - A Cleveland man accused of fatally shooting his 12-year-old stepdaughter and injuring his estranged wife was taken into custody for alleged crimes including aggravated murder and domestic violence.

Police arrested 59-year-old Rufus Gray on Thursday night after the shooting that killed Davia Garth. Charges were pending, and it wasn’t clear Friday whether Gray has an attorney.

Local media report Gray’s wife was seeking a divorce. Sonya Garth tells the Northeast Ohio Media Group (https://bit.ly/13plrkc ) that she was home with her children and that Gray walked into the home, said he was going to kill them and then opened fire.

The news organization reported that Garth’s 24-year-old son wrestled a gun from Gray’s hands and beat him.

Gray’s criminal record includes domestic violence and other charges.
