HATTIESBURG, Miss. (AP) - A Lamar County man has filed an alienation of affection lawsuit against Forrest County Sheriff Billy McGee.

The Hattiesburg American (https://hatne.ws/1uLcuwJ) reports that the civil suit was filed Thursday in the Forrest County Circuit Clerk’s office by David “Mickey” Lyon, 42, of Hattiesburg.

The suit alleges McGee “”willfully, actively, wrongfully and intentionally interfered with the marital relationship of Plaintiff and his wife, thereby causing an alienation of Emma Lyon’s affections toward the plaintiff.”

The lawsuit seeks $1 million in actual damages and $4 million in punitive damages, along with attorney fees.

McGee said he will hire a lawyer and let the courts decide the matter.



“I don’t have a response. I have not seen the lawsuit, and I did not steal his wife,” the sheriff said.

Jay Jernigan, Mickey Lyon’s attorney, said his client learned of an affair between McGee and his wife last fall and since that time the couple has divorced.

“He has a real good case, his wife admitted in the divorce that she was having an affair,” Jernigan said.

However, the attorney said Emma Lyon, 38, did not name McGee as the man she had been involved with in a long-term relationship.

When asked why he was filing the suit, Mickey Lyon said McGee interfered with his attempts to reconcile his marriage, and the divorce cost him a lot of money through legal fees and other expenses.

“And I now only have my children every other weekend and one day during the week,” he said.

The Lyons’ divorce was finalized on June 3, but Mickey Lyon said his ex-wife initially told him she wanted a divorce earlier in 2013.

“I told her I did not want a divorce, so we went to counseling for several months,” he said. “She stopped going to counseling and filed for divorce.”

Lyon said at that point, he was still trying to reconcile the marriage and continued going to counseling.

At that time, he said he heard from various sources that his wife was having an affair with McGee.
