CONROE, Texas (AP) - A judge has ordered the trial moved in the capital murder case of a Texas man in a childhood attack on a boy who died nearly 13 years later.

The judge Wednesday ordered the trial of Don Wilburn Collins moved from Conroe in Montgomery County to Galveston, 90 miles to the southeast.

The judge earlier this week had granted a defense motion to move the trial after defense attorneys argued intense pretrial publicity made the prospect of a fair trial difficult.

Authorities say Collins was 13 when he poured gasoline on Robert Middleton and set him on fire during Middleton’s eighth birthday in 1998.

Middleton survived but died in 2011 of skin cancer authorities blamed on his injuries.

Collins’ trial is set for Jan. 5.
