TEXARKANA, Ark. (AP) - A wrongful death lawsuit has been filed against a Texarkana liquor store and three of its employees.

Attorney Mark Burgess filed the lawsuit last week on behalf of Josh Bishop, 28, who died in February. It claims Bishop’s death was the result of a Jan. 25 assault by Chubby Cheeks Liquor LLC employees who suspected him of shoplifting, the Texarkana Gazette (https://bit.ly/1tC8adq ) reported. Allen Rogers, Lane Rogers, a security guard and the liquor store are named in the lawsuit.

The lawsuit accuses the men of handcuffing, beating and holding Bishop and his friend, Wesley Attaway, at gunpoint.

“Paramedics informed me the injuries the suspects had sustained were more severe than initially perceived,” according to a one-page police report detailing the incident.

Bishop was taken to a local hospital, where he received surgery for head injuries and was prescribed liquid hydrocodone for pain. He was later released before returning to the hospital Feb. 20 for more surgery. He died Feb. 23.

Allen Rogers, who owns the store, declined to comment. A message seeking comment was left for Lane Rogers Tuesday at Chubby Cheeks, according to the newspaper.

The defendants have not yet responded to the lawsuit in court.
