MITCHELL, S.D. (AP) - NASCAR driver Clint Bowyer is asking the South Dakota Supreme Court to move a motorcycle company’s lawsuit against him to North Carolina.

Klock Werks Kustom Cycles in Mitchell sued Bowyer for allegedly not paying for $31,000 of custom work it did on his Harley-Davidson in 2009. A judge earlier ruled that the dispute should be settled in a South Dakota court.

KELO-TV reports (https://bit.ly/1vOd2Qg ) that Bowyer’s attorneys are appealing. They say the racer never came to South Dakota because of the bike work and that the lawsuit should be litigated in the state where he lives and where the motorcycle was delivered.

Bowyer maintains he fulfilled his obligation by promoting the bike and the Mitchell company, and providing owner Brian Klock and friends with behind-the-scenes access to a NASCAR race.
