LANCASTER, Pa. (AP) - A Pennsylvania man involved in a fatal boating accident will avoid prison if he completes a court-supervised program for first-time offenders.

Lancaster Online reports (https://bit.ly/W7hlJ0 ) 21-year-old Brandon Allen appeared at a hearing Tuesday regarding the accident in the Susquehanna River near Drumore.

Allen faced two misdemeanor counts of homicide by watercraft for the accidental drowning deaths of two friends, 20-year-old Cody Moyer and 21-year-old Jonny Velez.

Authorities say Allen’s 10-foot boat was overloaded and had no floatation devices when it capsized last summer in the Conowingo Reservoir. Allen was able to swim to shore.

Lawyers say the victims’ parents approved of the sentence for Allen, of Muhlenberg Township. He must serve four years of probation.



In court, Allen cried and said, “I just wish I could trade places.”
